No.337-TA-1003): it ruled that two Chinese companies, Nanuo Technology and Guangdong Ailisheng, were infringing intellectual property rights and decided to terminate the investigation.
The investigation originated in May 2016, when Aspen Aerogels filed a 337 investigation application with ITC in the United States, claiming that the products of Guangdong Ailisheng High-tech Co., Ltd. and Zhejiang Nanuo Technology Co., Ltd. from China infringed their patents related to composite aerogel thermal insulation materials and manufacturing methods ( patents US6989123, US7078359, US7399439, US7780890 and US9181486),and they request ITC to issue general exclusion order (or limited exclusion order) and prohibition order.
On June 2, 2016, the US International Trade Commission voted to launch the 337 investigation. According to the 337 investigation application filed by the Committee, the two aerogel enterprises involved in the case are suspected of infringing the composite aerogel insulation materials and manufacturing methods exported, imported or sold in the United States. In September 2017, ITC issued a preliminary ruling, and found that two Chinese enterprises involved in the case had infringement.
On February 5, 2018, ITC of the United States issued a notice saying that its 337 investigation part was finalized, ruled that two enterprises had infringed intellectual property rights, and decided to terminate the investigation. It is found that Guangdong Ailisheng Company infringed claims 1, 7 and 9 of patent U.S. US7078359, claims 11-13, 15 and 19 of patent U.S. US6989123 and claims 11-13, 15, 17-19 and 21 of patent U.S. US7780890; It is found that Nanuo Company infringed the 12th, 15th and 16th rights of patent US7078359.
